Introduction of the Penal Code (Amendment) Bill of Bhutan 2019

The Legislative Committee of National Council of Bhutan introduced the Penal Code (Amendment) Bill of Bhutan 2019 today.

The Bill was tabled on 29th May 2019 and passed on June 10, 2019 during the Third Session of the Parliament. 

The Legislative Committee of the House was assigned to review and prepare for the deliberation on the Bill.

Hon’ble Choining Dorji, Chair of the Legislative Committee, reported that considering the importance of the Bill, the Committee had done extensive research and consultation with the relevant agencies. He further reported that the Committee had not only carried out review on the amendments received from the National Assembly but also did an in-depth review of all the sections of the Bill.

Hon’ble Dhan Kumar Sunwar, Deputy Chair of the Committee, presented the amendments of the Committee.  He reported that the National Assembly had made a total of 14 changes to the Bill: 8 amendments, insertion of 2 new sections and removal of 4 sections. He informed the House that the LC in total has proposed a total of 51 changes to the Bill: 16 amendments, insertion of 8 new sections, removal of 20 sections, and retention of 7 sections.  

In total, there are 514 sections and 35 Chapters in the original Act (2004). The Bill was last amended in 2011.

Besides submitting their concerns, the Members sought clarification on proposed amendments. The Members also submitted their views on life imprisonment, trafficking of persons, grading of statutory rape, increasing overall rape sentences, value based sentencing, and unnatural sex.

The House directed the Committee to re-deliberate in the meeting to discuss the sections taking into consideration all the comments and views submitted by members.

The House will continue the deliberation on Monday.
